1 Who We Are

PIKAX LABS ("PIKAX", "we", "our", or "us") operates the PIKAX Network' app and website at pikaxlabs.com. We are the data controller for personal information collected through these services.

2 Data We Collect

We collect the minimum data necessary to operate the PIKAX app. Here is a full breakdown:

🚫 We do NOT collect: Government IDs, financial information, precise GPS location, contacts, photos/media from your device, or biometric data. The app does not request these permissions.

3Third-Party Services

PIKAX uses Google for its backend infrastructure. Database services are subject to Google's Privacy Policy in addition to ours.

Auth

Authentication — Email/password login and session management. Data stored in Google Cloud.

Firestore

Cloud Firestore — Sessions, PKX balances, referral trees, and user profiles. Encrypted at rest using AES-256.

Analytics

Analytics — Anonymous event tracking. User IDs are pseudonymised. IP addresses are truncated before storage.

Crashlytics

Crashlytics — Automatic crash reports for app stability. No personal data is included in crash logs.

FCM

Cloud Messaging — Push notifications for session reminders. You can opt out in app settings.


Google Database may transfer data to Google's global infrastructure. We have configured our project to prioritise all the region, but replication may occur globally under Google's standard service terms.

4 How We Use Your Data

We use your personal data only for the purposes described at collection. We never use your data for:

  • Selling or renting to third-party advertisers or data brokers
  • Profiling for targeted advertising outside the PIKAX platform
  • Automated decision-making that produces legal effects
  • Any purpose incompatible with those listed in Section 2

Permitted uses:

  • Operating and improving the PIKAX app and website
  • Calculating and crediting PKX balances accurately
  • Sending transactional emails (login verification, password reset)
  • Sending optional marketing emails (only with explicit consent, easy unsubscribe)
  • Fraud prevention and abuse detection
  • Complying with legal obligations (tax, court orders, law enforcement)

5 Your Rights

Under the Digital Personal Data Protection Act 2023 (India) and in line with GDPR principles, you have the following rights:

Delete your account at any time through Account Settings. Your name, email, and personal identifiers are permanently removed. Your PKX balance is forfeited. Analytics data remains in fully anonymised form.

Request your account data in machine-readable (JSON) format at any time.

Opt out of non-essential communications at any time through app notification settings.

6 Data Security

  • Encryption at rest: AES-256 encryption for all Firestore data.
  • Encryption in transit: TLS 1.3 for all API communications.
  • Access control: Firebase security rules restrict data access strictly to authenticated owners. No team member can read your session data without an explicit support ticket.
  • Breach notification: In the event of a personal data breach, we will notify affected users and the relevant supervisory authority within 72 hours as required by law.

7 Children's Privacy

PIKAX is not intended for children under 13 years of age. We do not knowingly collect personal data from children under 13. If you are a parent or guardian and believe your child has provided us with personal data, please contact [email protected] immediately and we will delete that information within 48 hours.


⚠️ In jurisdictions where the age of digital consent is higher than 13 (e.g. 16 in Germany, 18 in some contexts), you must meet that higher age requirement to use PIKAX.

8 Policy Updates

We may update this Privacy Policy from time to time. When we make material changes, we will notify you via email or an in-app notification at least 14 days before the changes take effect. Continued use of PIKAX after the effective date constitutes acceptance of the revised policy.

1 Acceptance of Terms

By downloading the PIKAX app, creating an account, or visiting pikaxlabs.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use PIKAX. These Terms form a legally binding contract between you and PIKAX Labs.

2 Eligibility

  • You must be at least 13 years old (or the age of digital consent in your country, whichever is higher).
  • You must not be located in a jurisdiction where cryptocurrency activities are prohibited by law.
  • You must not be on any government sanctions list (OFAC, UN, EU).
  • Corporate accounts are not permitted during the contribution phase. Each account must represent a natural person.

3 PKX Token — Nature & Risks

Not a Financial Instrument. PKX is a utility token intended for use within the PIKAX ecosystem. It is NOT a security, NOT an investment product, and NOT a promise of financial return. Do not make financial decisions based on speculative PKX value.

You acknowledge and accept the following risks:

No Guaranteed ValuePKX may have zero market value at any point, including at mainnet launch.
Regulatory RiskLaws governing cryptocurrency may change and may affect your ability to use or transfer PKX.
Technical RiskSmart contract vulnerabilities, network outages, and bugs may affect PKX balances.
Halving RiskContribution rates will decrease as the network grows, per the published schedule.
Loss of AccessIf you lose access to your account credentials and cannot verify ownership, we may not be able to restore your balance.

4 Acceptable Use

You agree NOT to:

  • Use bots, scripts, automated tools, or modified versions of the app to simulate activity
  • Create multiple accounts to artificially inflate referral bonuses (one account per person, enforced by device fingerprinting)
  • Manipulate leaderboards through coordinated inauthentic activity
  • Attempt to hack, reverse-engineer, or exploit any part of the PIKAX platform
  • Use PIKAX for money laundering, fraud, or any illegal activity
  • Harass, threaten, or abuse other community members
  • Post spam or misleading information about PKX value in community channels

Zero Tolerance for Abuse. Violation of these rules results in immediate account termination and permanent forfeiture of all PKX. PIKAX Labs will not restore accounts terminated for abuse under any circumstances.

5 PKX Balance & Mainnet Migration

All PKX accumulated during the pre-mainnet phase is held as an in-app balance. Upon mainnet deployment (targeted Q4 2026):

  • Balances will be migrated to on-chain wallets on the selected blockchain (BNB Smart Chain, Polygon, or Solana — to be announced at launch).
  • You will be required to complete basic KYC verification to receive mainnet PKX. This is a legal requirement for the token distribution event.
  • Unclaimed mainnet PKX (where KYC is not completed within 180 days of mainnet launch) will be returned to the ecosystem reserve pool.
  • PIKAX Labs reserves the right to adjust the migration process, timeline, and technical implementation with 30 days' notice to users.

6 Referral Program Rules

  • Referral bonuses are credited only when the referred user contributes actively for 7 consecutive days.
  • Referral fraud (creating fake accounts to claim bonuses) results in immediate termination of both the referrer and referred account.
  • PIKAX Labs may audit referral networks at any time and revoke fraudulently obtained bonuses.
  • Referral rates and tier thresholds may be adjusted at any time with 14 days' notice.

7 Limitation of Liability

To the maximum extent permitted by applicable law, PIKAX Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, PKX value, data, or goodwill, arising from your use of or inability to use the PIKAX platform.


Our total liability to you for any claim arising out of or relating to these Terms or the PIKAX platform shall not exceed the amount you have paid to PIKAX Labs in the 12 months preceding the claim (which for free-tier users is zero).

8 Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in New Delhi under the Arbitration and Conciliation Act, 1996.


Nothing in this clause prevents you from filing a complaint with the Data Protection Board of India regarding personal data processing.
